Cabinet Resolution No. (8) of 2014
Concerning the Fees for Licenses and Services Provided by the Federal Authority for Nuclear Regulation
The Cabinet,
- Having reviewed the Constitution,
- And Federal Law No. (1) of 1972 concerning the Competencies of Ministries and Powers of Ministers, and its amendments,
- And Federal Decree-Law No. (6) of 2009, concerning the Peaceful Uses of Nuclear Energy,
- And Federal Law No. (1) of 2011, concerning the Public Revenues of the State,
- And based on the proposal of the Minister of Finance, and the approval of the Cabinet,
Has decided:
Article (1)
The words and phrases mentioned in this Resolution shall have the meanings assigned to them in Article (1) of Federal Decree-Law No. (6) of 2009 concerning the Peaceful Uses of Nuclear Energy, unless the context otherwise requires.
Article (2)
1. Annual fees shall be collected at the beginning of each fiscal year after the entry into force of this Resolution from licensees conducting regulated activities related to a nuclear facility, set at 90% of the Authority's approved budget for that fiscal year.
2. The fees referred to in paragraph (1) of this Article shall cover the regulatory and control activities conducted by the Authority and any licenses issued to licensees to conduct any regulated activities related to a nuclear facility, with the exception of the fees for issuing other licenses specified in the tables attached to this Resolution.
3. The annual fees to be collected, as referred to in paragraph (1) of this Article, shall be divided among the licensees conducting regulated activities related to a nuclear facility, in case there are multiple licensees, in accordance with what is determined by the Ministry of Finance based on the recommendation of the Board.
Article (3)
1. The fees specified in the tables attached to this Resolution shall be collected from licensees for the services of issuing and renewing licenses to conduct regulated activities related to regulated materials for the purposes specified in those tables.
2. The validity period of the license referred to in paragraph (1) of this Article shall be three years.
Article (4)
The Cabinet shall be competent to make any amendments to the fees stipulated in this Resolution, whether by addition, deletion, or modification.
Article (5)
The fees stipulated in this Resolution shall be collected through the means determined by the Ministry of Finance in this regard.
Article (6)
The Chairman shall issue the necessary procedures for the implementation of this Resolution in coordination with the Minister of Finance.
Article (7)
This Resolution shall be published in the Official Gazette and shall come into force on the day following the date of its publication.
