قرار مجلس الوزراء رقم (12) لسنة 2021
في شأن رسوم الخدمات التي تقدمها وزارة الطاقة والبنية التحتية
مجلس الوزراء:
— بعد الاطلاع على الدستور،
— وعلى القانون الاتحادي رقم (1) لسنة 1972 بشأن اختصاصات الوزارات وصلاحيات الوزراء، وتعديلاته،
— وعلى القانون الاتحادي رقم (26) لسنة 1981 بشأن القانون التجاري البحري، وتعديلاته،
— وعلى القانون الاتحادي رقم (9) لسنة 2011 في شأن النقل البري، وتعديلاته،
— وعلى القانون الاتحادي رقم (14) لسنة 2016 بشأن المخالفات والجزاءات الإدارية في الحكومة الاتحادية،
— وعلى القانون الاتحادي رقم (14) لسنة 2017 بشأن تداول المواد البترولية،
— وعلى المرسوم بقانون اتحادي رقم (26) لسنة 2019 في شأن المالية العامة،
— وعلى قرار مجلس الوزراء رقم (27) لسنة 2005 بشأن رسوم الخدمات التي تقدمها إدارة الشؤون البحرية بوزارة المواصلات،
— وعلى قرار مجلس الوزراء رقم (17) لسنة 2010 في شأن تنظيم استخدام واستغلال الطرق والمنشآت الاتحادية،
— وعلى قرار مجلس الوزراء رقم (28) لسنة 2012 بشأن الرسوم والغرامات الاتحادية لخدمات قطاع النقل البري بالدولة،
— وعلى قرار مجلس الوزراء رقم (7) لسنة 2013 بشأن رسوم بيع التقارير والمطبوعات والخرائط الجيولوجية،
— وعلى قرار مجلس الوزراء رقم (4) لسنة 2015 في شأن رسوم الخدمات التي تقدمها وزارة تطوير البنية التحتية، وتعديلاته،
— وبناءً على ما عرضه وزير المالية، وموافقة مجلس الوزراء،
قرر:
المادة (1)
التعريفات
في تطبيق أحكام هذا القرار، يُقصد بالكلمات والعبارات التالية المعاني المبيّنة قرين كل منها، ما لم يقض سياق النص بغير ذلك:
الدولة : الإمارات العربية المتحدة.
الوزارة : وزارة الطاقة والبنية التحتية.
الوزير : وزير الطاقة والبنية التحتية.
المختبر : المختبر التابع للوزارة، المختص بفحص المواد الإنشائية.
السجل : أي سجل ينشأ في الوزارة، تدون فيه بيانات متعهدي أبحاث التربة أو الاستشاريين أو المقاولين أو الموردين للأعمال الإنشائية.
الطرق والمنشآت الاتحادية : الطرق والمنشآت الخاضعة لأحكام هذا القرار والتي يصدر بتحديدها قرار من الوزير.
الرخصة التشغيلية : الترخيص الصادر عن الوزارة لمزاولة نشاط النقل البري.
البطاقة التشغيلية : الوثيقة الصادرة من الوزارة والتي بمقتضاها يصرح لوسيلة النقل البري بالعمل في مجال النشاط المرخص به بالدولة.
أندية السيارات والسياحة : الجهة المعتمدة في الدولة لتقديم خدمات عامة لأصحاب السيارات، كإصدار دفاتر المرور CPD للمركبات الخاصة، ورخصة قيادة دولية IDL.
النقل البري الدولي : أي نقل بري على الطرق للأشخاص أو البضائع من الدولة إلى الخارج أو العكس بوسائل نقل بري مرخصة مقابل أجر.
الضامن : الجهة التي تؤسس في الدولة وفقاً لأحكام القانون الاتحادي رقم (9) لسنة 2011 في شأن النقل البري، والتي تضمن سداد الرسوم والضرائب الخاصة بالناقلات الوطنية والأجنبية بموجب بطاقات النقل البري الصادرة عنها أو عن جهة مماثلة في دولة أخرى.
الوكيل المحلي : الشخص الطبيعي أو الاعتباري المعين من قبل شركة النقل أو الشحن الدولية لتمثيلها في كافة ما يتصل بالالتزامات والإجراءات المعمول بها فيما يتصل بالنقل البري في الدولة.
المادة (2)
رسوم الخدمات
1. تستوفى نظير الخدمات التي تقدمها الوزارة الموضحة في الجداول رقم (1) ورقم (2) ورقم (3) ورقم (6) ورقم (7) المرفقة بهذا القرار، الرسوم المبينة قرين كل منها.
2. يستوفى رسم نقل ملكية سفينة تجارية وطنية مقداره (6.5) درهم عن كل (طن) من الحمولة الكلية للسفينة، على ألا يكون الحد الأعلى للرسوم (عشرة آلاف درهم) ويجب ألا يقل عن (200) درهم.
3. يستوفى رسم إصدار ترخيص لسفينة نزهة مملوكة لأجنبي مقداره (6.5) درهم عن كل (طن) من الحمولة الكلية للسفينة، كما يستوفى عن تجديد هذا الترخيص رسم مقداره (3) دراهم عن كل (طن) من الحمولة الكلية للسفينة، على ألا يقل هذا الرسم عن (500) درهم.
4. يستوفى عند إصدار كل ترخيص ملاحي للسفينة الأجنبية التي تعمل في المياه الإقليمية للدولة رسم مقداره (7) دراهم عن كل طن من الحمولة الكلية المسجلة للسفينة، وعند تمديده لمدة لا تتجاوز سنة يستوفى رسم مقداره (5) دراهم عن كل طن من الحمولة الكلية المسجلة للسفينة، على أن يكون الحد الأعلى للرسم (150.000 درهم ويجب ألا يقل عن (500) درهم.
5. ألغيت بموجب قرار مجلس الوزراء رقم (76) لسنة 2022.
6. ألغيت بموجب قرار مجلس الوزراء رقم (76) لسنة 2022.
7. لا تشمل رسوم الخدمات الواردة في البنود من (204) حتى (268) مصاريف التغليف أو الشحن أو الجمارك.
المادة (3)
المخالفات والغرامات الإدارية
1. تستوفي الوزارة الغرامات الإدارية الموضحة في الجدول رقم (4) المرفق بهذا القرار.
2. تستوفي الوزارة الغرامات الإدارية الموضحة في الجدول رقم (5) المرفق بهذا القرار عن الإشغالات والأضرار الناجمة عن الحوادث والتجاوزات على الطرق الاتحادية.
3. تستوفي الوزارة الغرامات الإدارية الآتية:
أ. تفرض على متعهدي أبحاث التربة غرامة إدارية قدرها (100) مائة درهم، وذلك عن كل سنة يتم التأخر فيها عن تجديد القيد في السجل.
ب. تفرض على الاستشاريين والمقاولين والموردين للأعمال الإنشائية غرامة إدارية قدرها (500) خمسمائة درهم، وذلك عن كل سنة يتم التأخر فيها عن تجديد القيد في السجل.
ج. يتم استيفاء قيمة الغرامات المشار إليها في الفقرتين (أ) و (ب) من هذه المادة، بالإضافة إلى رسوم تجديد القيد في السجل المبينة في الجدول المرفق بهذا القرار وبما لا يزيد على ثلاث سنوات، وفي حالة عدم تجديد القيد في السجل لمدة تزيد على ذلك، فيتم إلغاء القيد من السجل.
د. لغايات احتساب الغرامات المشار إليها في الفقرتين (أ) و (ب) من هذه المادة، يعتبر جزء السنة سنة كاملة.
ه. تفرض غرامة إدارية إذا لم يجدد ترخيص سفينة النزهة (مواطن - أجنبي) خلال (60) يوم من تاريخ انتهائه بواقع (50) درهم عن كل شهر تأخير أو جزء منه على أن يكون الحد الأعلى للغرامة (200) درهم.
و. تفرض غرامة إدارية إذا لم يجدد ترخيص الملاحة للسفن التجارية الوطنية خلال (60) يوم من تاريخ انتهائه بواقع (100) درهم عن كل شهر تأخير أو جزء منه، على أن يكون الحد الأعلى للغرامة (1000) درهم.
ز. تفرض غرامة إدارية إذا لم تجدد وثيقة التطقيم الأدنى الآمن لسفينة تجارية وطنية خلال (60) يوم من تاريخ انتهائها بواقع (50) درهم عن كل شهر تأخير أو جزء منه على أن يكون الحد الأعلى للغرامة (300) درهم.
ح. تفرض غرامة إدارية إذا لم يجدد الترخيص الخاص بالعمل على إحدى السفن خلال (60) يوم من تاريخ انتهائه بواقع (50) درهم عن كل شهر تأخير أو جزء منه، على أن يكون الحد الأقصى للغرامة (200) درهم.
4. لكل ذي مصلحة، التظلم خطياً إلى الوزارة من أي غرامة إدارية من الغرامات المشار إليها في هذا القرار تم اتخاذها بحقه، وذلك خلال (15) خمسة عشر يوماً من تاريخ إخطاره بالقرار المتظلم منه، على أن يكون التظلم مسبباً ومرفقاً به كافة المستندات المؤيدة له، ويتم البت في هذا التظلم خلال (30) ثلاثين يوماً من تاريخ تقديمه، ووفق الإجراءات المعمول بها لدى الوزارة.
المادة (4)
تعديلات الرسوم والغرامات
يختص مجلس الوزراء بإجراء أية تعديلات على الرسوم والغرامات الإدارية الواردة في هذا القرار، سواء بالإضافة أو الحذف أو التعديل.
المادة (5)
تحصيل الرسوم والغرامات
تحصل الرسوم والغرامات الواردة في هذا القرار بالوسائل التي تقررها وزارة المالية.
المادة (6)
الضمان البنكي
يلتزم كل من الضامن وأندية السيارات والسياحة بتقديم ضمان بنكي بقيمة مليون درهم باسم الوزارة صادر عن أحد البنوك العاملة بالدولة، عند إصدار رخصة ممارسة نشاط إصدار دفاتر المرور CPD للمركبات الخاصة، ورخصة قيادة دولية IDL، وبطاقة مرور للشاحنات وحافلات الركاب، وتكون صلاحية الضمان البنكي لمدة غير محددة، ولا يعاد الضمان البنكي لصاحب الترخيص، إلا بعد مضي (90) يوماً من تاريخ إلغاء الرخصة.
المادة (7)
تكاليف تصميم وتنفيذ مداخل المشاريع الاستثمارية الخاصة
تستوفى الوزارة تكاليف تصميم وتنفيذ أية مداخل دائمة للمشاريع الاستثمارية الخاصة على الطرق الاتحادية من الجهات المالكة لهذه المشاريع، مضافاً إليها نفقات إدارية وإشرافية ونفقات صيانة بنسبة (10%) من قيمة التكلفة، ويتم التنسيق بين الوزارة ووزارة المالية لتحديد آلية استيفاء تلك التكاليف من الجهات المالكة للمشاريع، وطريقة تسديد مستحقات الجهات التي تقوم بأعمال التصميم والتنفيذ.
تنظيم استغلال الطرق والمنشآت الاتحادية
المادة (8)
للوزارة دون غيرها حق استغلال الطرق والمنشآت الاتحادية بما يتوافق مع الأحكام الواردة في هذا القرار، ولها في ذلك تحديد حرم الطريق وفقاً للضوابط الصادرة عن الوزير في هذا الشأن.
المادة (9)
1. مع مراعاة الاختصاصات المقررة قانوناً لأية جهة اتحادية أخرى، تختص الوزارة بما يأتي:
أ. تقدير حجم الأضرار والمخالفات التي تنجم عن الحوادث المرورية والتعديات على الطرق الاتحادية وتحديد كلفة إصلاحها.
ب. تحديد تكاليف إزالة ومعالجة المخالفات والإشغالات والتي لا يقوم المخالفون بإزالتها أو معالجتها على نحو ما ترى الوزارة.
ج. تنفيذ الإصلاحات اللازمة لمعالجة آثار الحوادث المرورية والتعديات.
د. القيام بإزالة المخالفات المرتكبة إذا لم يتم إزالتها في الفترة التي تحددها الوزارة.
2. تتولى الوزارة إبلاغ المتسببين والمخالفين لأحكام هذا القرار بتسديد كلفة أعمال الإصلاح والإزالة المشار إليها أعلاه مضافاً إليها نسبة 15% كنفقات إدارية وإشرافية وتورد إلى الخزانة العامة للدولة.
3. على الوزير أو من يفوضه النظر في طلبات التظلم التي ترد للوزارة في شأن ما ورد في الفقرة (1) من هذه المادة، على أن تحدد الآلية المناسبة لقبول تلك التظلمات خلال مدة شهر من تاريخ إخطار المتسببين والمخالفين بتسديد كلف الإصلاح والإزالة، وتكون قرارات الوزير أو من يفوضه نهائية في التظلمات المرفوعة إليه بهذا الشأن.
المادة (10)
تلتزم الجهات المصرح لها بالعمل في حرم الطرق والمنشآت الاتحادية بتقديم الضمانات المالية التي تحددها الوزارة كضمان لالتزام تلك الجهات بمراعاة المواصفات الفنية والقانونية للطرق وإصلاح أية أضرار قد تلحق بالطريق أو ملحقاته، ويكون ذلك إما من خلال:
أ. تقديم ضمانات في صورة مبالغ يتم إيداعها نقداً في الحسابات المصرفية التي تحددها وزارة المالية لهذا الغرض.
ب. تقديم خطابات ضمان من أحد البنوك العاملة في الدولة، على أن تكون غير مشروطة، وغير قابلة للإلغاء، وبنفس المبالغ، وذلك وفقاً للأسس التي تحددها الوزارة بالتنسيق مع وزارة المالية.
المادة (11)
1. للوزارة تحصيل رسوم مقابل نشر الإعلانات ووسائل الدعاية على الطرق والمنشآت الاتحادية على أن يتم تحديد هذه الرسوم بالتنسيق مع وزارة المالية ووفقاً للضوابط واللوائح المنفذة لهذا القرار، ويصدر بهذه الرسوم قرار من مجلس الوزراء بناءً على عرض وزير المالية.
2. للوزارة الحق في إبرام العقود مع الشركات والمؤسسات المتخصصة لمنحها حق استغلال الطرق والمنشآت الاتحادية بالإعلانات ووسائل الدعاية وذلك وفقاً لنظام المناقصات أو المزايدات المعمول به في الحكومة الاتحادية.
المادة (12)
للوزارة تحصيل رسوم مقابل استخدام الطرق والمنشآت الاتحادية بعد التنسيق مع وزارة المالية ووزارة الداخلية، ويصدر مجلس الوزراء قراراً بتلك الرسوم ومواعيد تحصيلها بناءً على عرض وزير المالية.
المادة (13)
للوزارة حق تحديد السرعات المسموح بها على الطرق الاتحادية، وأماكن تركيب الرادارات عليها بالتنسيق مع وزارة الداخلية، على أن تؤول كافة إيرادات الرادارات المثبتة على الطرق الاتحادية إلى الخزانة العامة للدولة.
أحكام ختامية
المادة (14)
يكون لموظفي الوزارة الذين يصدر بتحديدهم قرار من وزير العدل بالاتفاق مع الوزير صفة مأموري الضبط القضائي في ضبط وإثبات ما يقع من مخالفات وفقاً لأحكام هذا القرار واللوائح والضوابط المنفذة له، وذلك في نطاق اختصاص كل منهم.
المادة (15)
القرارات التنفيذية
1. يصدر الوزير القرارات اللازمة لتنفيذ أحكام هذا القرار.
2. يحدد الوزير الطرق والمنشآت الاتحادية التي يسري عليها هذا القرار.
المادة (16)
الإلغاءات
1. تُلغى كل من القرارات الآتية:
أ. قرار مجلس الوزراء رقم (27) لسنة 2005 بشأن رسوم الخدمات التي تقدمها إدارة الشؤون البحرية بوزارة المواصلات.
ب. قرار مجلس الوزراء رقم (17) لسنة 2010 في شأن تنظيم استخدام واستغلال الطرق والمنشآت الاتحادية.
ج. قرار مجلس الوزراء رقم (28) لسنة 2012 بشأن الرسوم والغرامات الاتحادية لخدمات قطاع النقل البري بالدولة.
د. قرار مجلس الوزراء رقم (7) لسنة 2013 بشأن رسوم بيع التقارير والمطبوعات والخرائط الجيولوجية والجيوفيزيائية.
ه. قرار مجلس الوزراء رقم (4) لسنة 2015 في شأن رسوم الخدمات التي تقدمها وزارة تطوير البنية التحتية وتعديلاته.
و. قرار وزير المالية رقم (268) لسنة 2006.
ز. قرار وزير المالية رقم (108) لسنة 2007.
2. يلغى كل حكم يخالف أو يتعارض مع هذا القرار.
المادة (17)
نشر القرار والعمل به
ينشر هذا القرار في الجريدة الرسمية، ويُعمل به من اليوم التالي لتاريخ نشره.

In the application of the provisions of this Resolution, the following words and phrases shall have the meanings assigned to each of them, unless the context otherwise requires:
The State: The United Arab Emirates.
The Ministry: The Ministry of Energy and Infrastructure.
The Minister: The Minister of Energy and Infrastructure.
The Laboratory: The laboratory affiliated with the Ministry, specialized in testing construction materials.
The Register: Any register established at the Ministry, in which the data of soil investigation contractors, consultants, contractors, or suppliers for construction works are recorded.
Federal Roads and Facilities: The roads and facilities subject to the provisions of this Resolution, which shall be specified by a decision of the Minister.
Operating License: The license issued by the Ministry to practice land transport activity.
Operating Card: The document issued by the Ministry by which a land transport vehicle is authorized to operate in the field of the licensed activity in the State.
Automobile and Touring Clubs: The entity accredited in the State to provide public services to car owners, such as issuing Carnets de Passages en Douane (CPD) for private vehicles, and International Driving Licenses (IDL).
International Land Transport: Any land transport by road for persons or goods from the State to abroad or vice versa by licensed land transport means for a fee.
The Guarantor: The entity established in the State in accordance with the provisions of Federal Law No. (9) of 2011 concerning Land Transport, which guarantees the payment of fees and taxes for national and foreign carriers under the land transport cards issued by it or by a similar entity in another country.
The Local Agent: The natural or legal person appointed by an international transport or shipping company to represent it in all matters related to the obligations and procedures in effect concerning land transport in the State.
Article (2)
Service Fees
1. For the services provided by the Ministry as specified in Schedules No. (1), No. (2), No. (3), No. (6), and No. (7) attached to this Resolution, the fees indicated next to each shall be collected.
2. A fee for transferring the ownership of a national commercial vessel of (6.5) dirhams shall be collected for each (ton) of the vessel's gross tonnage, provided that the maximum fee is (ten thousand dirhams) and not less than (200) dirhams.
3. A fee for issuing a license for a pleasure boat owned by a foreigner of (6.5) dirhams shall be collected for each (ton) of the vessel's gross tonnage, and for the renewal of this license, a fee of (3) dirhams shall be collected for each (ton) of the vessel's gross tonnage, provided that this fee is not less than (500) dirhams.
4. Upon issuing each navigation license for a foreign vessel operating in the territorial waters of the State, a fee of (7) dirhams shall be collected for each ton of the vessel's registered gross tonnage, and upon its extension for a period not exceeding one year, a fee of (5) dirhams shall be collected for each ton of the vessel's registered gross tonnage, provided that the maximum fee is (150,000) dirhams and not less than (500) dirhams.

7. The service fees listed in items from (204) to (268) do not include packaging, shipping, or customs expenses.
Article (3)
Administrative Violations and Fines
1. The Ministry shall collect the administrative fines specified in Schedule No. (4) attached to this Resolution.
2. The Ministry shall collect the administrative fines specified in Schedule No. (5) attached to this Resolution for occupations and damages resulting from accidents and encroachments on federal roads.
3. The Ministry shall collect the following administrative fines:
a. An administrative fine of (100) one hundred dirhams shall be imposed on soil investigation contractors for each year of delay in renewing their registration in the Register.
b. An administrative fine of (500) five hundred dirhams shall be imposed on consultants, contractors, and suppliers for construction works for each year of delay in renewing their registration in the Register.
c. The value of the fines referred to in paragraphs (a) and (b) of this Article shall be collected in addition to the fees for renewing the registration in the Register as specified in the Schedule attached to this Resolution, for a maximum of three years. In case of non-renewal of the registration for a period exceeding that, the registration shall be canceled from the Register.
d. For the purpose of calculating the fines referred to in paragraphs (a) and (b) of this Article, a part of a year shall be considered a full year.
e. An administrative fine shall be imposed if the license of a pleasure boat (citizen - foreigner) is not renewed within (60) days from its expiry date, at a rate of (50) dirhams for each month of delay or part thereof, with a maximum fine of (200) dirhams.
f. An administrative fine shall be imposed if the navigation license for national commercial vessels is not renewed within (60) days from its expiry date, at a rate of (100) dirhams for each month of delay or part thereof, with a maximum fine of (1000) dirhams.
g. An administrative fine shall be imposed if the minimum safe manning document for a national commercial vessel is not renewed within (60) days from its expiry date, at a rate of (50) dirhams for each month of delay or part thereof, with a maximum fine of (300) dirhams.
h. An administrative fine shall be imposed if the special license to work on a vessel is not renewed within (60) days from its expiry date, at a rate of (50) dirhams for each month of delay or part thereof, with a maximum fine of (200) dirhams.
4. Any interested party may submit a written grievance to the Ministry against any administrative fine imposed on them under this Resolution, within (15) fifteen days from the date of notification of the decision being grieved. The grievance must be reasoned and accompanied by all supporting documents. The grievance shall be decided upon within (30) thirty days from the date of its submission, in accordance with the procedures in effect at the Ministry.
Article (4)
Amendments to Fees and Fines
The Cabinet is competent to make any amendments to the fees and administrative fines stipulated in this Resolution, whether by addition, deletion, or modification.
Article (5)
Collection of Fees and Fines
The fees and fines stipulated in this Resolution shall be collected by the means decided by the Ministry of Finance.
Article (6)
Bank Guarantee
The Guarantor and the Automobile and Touring Clubs shall be obliged to provide a bank guarantee of one million dirhams in the name of the Ministry, issued by a bank operating in the State, upon the issuance of a license to practice the activity of issuing Carnets de Passages en Douane (CPD) for private vehicles, International Driving Licenses (IDL), and transit cards for trucks and passenger buses. The bank guarantee shall be valid for an indefinite period, and it shall not be returned to the license holder until (90) days have passed from the date of the license's cancellation.
Article (7)
Costs of Designing and Implementing Entrances for Private Investment Projects
The Ministry shall collect the costs of designing and implementing any permanent entrances for private investment projects on federal roads from the owning entities of these projects, in addition to administrative, supervisory, and maintenance expenses at a rate of (10%) of the cost value. Coordination shall take place between the Ministry and the Ministry of Finance to determine the mechanism for collecting these costs from the project-owning entities, and the method of settling the dues of the entities that carry out the design and implementation works.
Regulation of the Use and Exploitation of Federal Roads and Facilities
Article (8)
The Ministry, exclusively, has the right to exploit federal roads and facilities in accordance with the provisions of this Resolution, and for this purpose, it may determine the right-of-way according to the regulations issued by the Minister in this regard.
Article (9)
1. Without prejudice to the legally established competencies of any other federal entity, the Ministry is competent to do the following:
a. Assess the extent of damages and violations resulting from traffic accidents and encroachments on federal roads and determine the cost of their repair.
b. Determine the costs of removing and addressing violations and occupations that the violators do not remove or address as deemed appropriate by the Ministry.
c. Carry out the necessary repairs to address the effects of traffic accidents and encroachments.
d. Remove the committed violations if they are not removed within the period specified by the Ministry.
2. The Ministry shall notify the perpetrators and violators of the provisions of this Resolution to pay the cost of the repair and removal works mentioned above, plus 15% as administrative and supervisory expenses, which shall be deposited into the State's public treasury.
3. The Minister or his authorized representative shall consider the grievance requests received by the Ministry regarding what is stated in paragraph (1) of this Article. The appropriate mechanism for accepting such grievances shall be determined within a month from the date of notifying the perpetrators and violators to pay the repair and removal costs. The decisions of the Minister or his authorized representative shall be final on the grievances submitted to him in this regard.
Article (10)
Entities authorized to work within the right-of-way of federal roads and facilities shall provide the financial guarantees specified by the Ministry to ensure their compliance with the technical and legal specifications of the roads and to repair any damage that may occur to the road or its appurtenances. This can be done either through:
a. Providing guarantees in the form of amounts deposited in cash into the bank accounts specified by the Ministry of Finance for this purpose.
b. Providing letters of guarantee from a bank operating in the State, which must be unconditional, irrevocable, and for the same amounts, according to the principles determined by the Ministry in coordination with the Ministry of Finance.
Article (11)
1. The Ministry may collect fees for publishing advertisements and promotional materials on federal roads and facilities. These fees shall be determined in coordination with the Ministry of Finance and in accordance with the regulations and bylaws implementing this Resolution. A resolution on these fees shall be issued by the Cabinet based on the proposal of the Minister of Finance.
2. The Ministry has the right to conclude contracts with specialized companies and institutions to grant them the right to exploit federal roads and facilities for advertisements and promotional materials, in accordance with the tender or auction system in effect in the Federal Government.
Article (12)
The Ministry may collect fees for the use of federal roads and facilities after coordinating with the Ministry of Finance and the Ministry of Interior. The Cabinet shall issue a resolution on these fees and their collection dates based on the proposal of the Minister of Finance.
Article (13)
The Ministry has the right to determine the permissible speeds on federal roads and the locations for installing radars on them in coordination with the Ministry of Interior, provided that all revenues from radars installed on federal roads shall be transferred to the State's public treasury.
Final Provisions
Article (14)
The employees of the Ministry who are designated by a decision from the Minister of Justice in agreement with the Minister shall have the capacity of judicial officers to detect and establish violations in accordance with the provisions of this Resolution and its implementing regulations and controls, within the scope of each one's jurisdiction.
Article (15)
Executive Resolutions
1. The Minister shall issue the necessary resolutions to implement the provisions of this Resolution.
2. The Minister shall specify the federal roads and facilities to which this Resolution applies.
Article (16)
Repeals
1. The following resolutions are repealed:
a. Cabinet Resolution No. (27) of 2005 concerning the fees for services provided by the Maritime Affairs Department at the Ministry of Communications.
b. Cabinet Resolution No. (17) of 2010 concerning the regulation of the use and exploitation of federal roads and facilities.
c. Cabinet Resolution No. (28) of 2012 concerning Federal Fees and Fines for Land Transport Sector Services in the State.
d. Cabinet Resolution No. (7) of 2013 concerning fees for the sale of geological and geophysical reports, publications, and maps.
e. Cabinet Resolution No. (4) of 2015 concerning the fees for services provided by the Ministry of Infrastructure Development and its amendments.
f. Minister of Finance Resolution No. (268) of 2006.
g. Minister of Finance Resolution No. (108) of 2007.
2. Any provision that contradicts or conflicts with this Resolution is repealed.
Article (17)
Publication and Entry into Force of the Resolution
This Resolution shall be published in the Official Gazette and shall enter into force on the day following the date of its publication.
