في شأن منح علاوة فنية للجيولوجيين المواطنين العاملين بوزارة الطاقة
مجلس الوزراء،
- بعد الاطلاع على الدستور،
- وعلى القانون الاتحادي رقم (1) لسنة 1972، في شأن اختصاصات الوزارات وصلاحيات الوزراء والقوانين المعدلة له،
- وعلى القانون الاتحادي رقم (21) لسنة 2001، في شأن الخدمة المدنية في الحكومة الاتحادية والقوانين المعدلة له،
- وعلى قرار مجلس الوزراء رقم (12) لسنة 2003، في شأن اللائحة التنفيذية للقانون الاتحادي رقم (21) لسنة 2001 في شأن الخدمة المدنية في الحكومة الاتحادية وتعديلاته،
- وعلى قرار مجلس الوزراء رقم 206 / 5 لسنة 2005، بالموافقة على منح علاوة فنية للجيولوجيين المواطنين العاملين بوزارة الطاقة،
- وبناءً على ما عرضه وزير الدولة لشؤون مجلس الوزراء رئيس مجلس الخدمة المدنية، وموافقة مجلس الوزراء،
قرر:
المادة الأولى
يمنح الجيولوجيون المواطنون العاملون بوزارة الطاقة والبنية التحتية علاوة فنية بنسبة (30%) من الراتب الأساسي بحد أقصى (1500) درهم شهرياً.
المادة الثانية
يُشترط فيمن يمنح العلاوة المشار إليها في المادة الأولى من هذا القرار توافر الشروط الآتية:
- أن يكون حاصلاً على شهادة جامعية أو ما يعادلها في مجال التخصص.
- أن يكون مزاولاً لعمل جيولوجي بحت بوزارة الطاقة والبنية التحتية.
- أن يكون متفرغاً لعمله ولا يزاول عملاً خارجياً إلا في حدود ما تنص عليه المادة (64/ 5) من القانون الاتحادي رقم (21) لسنة 2001 في شأن الخدمة المدنية في الحكومة الاتحادية.
المادة الثالثة
لا تصرف العلاوة المشار إليها في المادة الأولى من هذا القرار للجيولوجيين المواطنين العاملين وزارة الطاقة والبنية التحتية شاغلي وظائف وكيل وزارة أو وكيل مساعد.
المادة الرابعة
على جميع الجهات تنفيذ هذا القرار كل فيما يخصه، ويعمل به اعتباراً من تاريخ صدوره، وينشر في الجريدة الرسمية.

Regarding the Granting of a Technical Allowance to National Geologists Working at the Ministry of Energy
The Cabinet of Ministers,
- Having reviewed the Constitution,
- And Federal Law No. (1) of 1972, concerning the competencies of ministries and the powers of ministers, and its amending laws,
- And Federal Law No. (21) of 2001, concerning the Civil Service in the Federal Government, and its amending laws,
- And Cabinet of Ministers Decision No. (12) of 2003, concerning the Executive Regulations of Federal Law No. (21) of 2001 on the Civil Service in the Federal Government, and its amendments,
- And Cabinet of Ministers Decision No. 206 / 5 of 2005, approving the granting of a technical allowance to national geologists working at the Ministry of Energy,
- And based on the proposal of the Minister of State for Cabinet Affairs, Chairman of the Civil Service Council, and the approval of the Cabinet of Ministers,
Has decided:
Article One
National geologists working at the Ministry of Energy and Infrastructure shall be granted a technical allowance of (30%) of the basic salary, with a maximum of (1500) dirhams per month.
Article Two
The granting of the allowance referred to in Article One of this decision is subject to the following conditions:
- To hold a university degree or its equivalent in the field of specialization.
- To be engaged in purely geological work at the Ministry of Energy and Infrastructure.
- To be fully dedicated to their work and not to engage in external work except within the limits stipulated in Article (64/5) of Federal Law No. (21) of 2001 concerning the Civil Service in the Federal Government.
Article Three
The allowance referred to in Article One of this decision shall not be disbursed to national geologists working at the Ministry of Energy and Infrastructure who occupy the positions of Undersecretary or Assistant Undersecretary.
Article Four
All competent authorities shall implement this decision, each within its own jurisdiction, and it shall come into force from the date of its issuance and shall be published in the Official Gazette.
