بشأن السياسة التنظيمية لشهادات إنتاج المياه منخفضة الكربون
رئيس دائرة الطاقة،
بعد الاطلاع على:
- القانون رقم (1) لسنة 1974 بشأن إعادة تنظيم الجهاز الحكومي في إمارة أبوظبي وتعديلاته.
- القانون رقم (11) لسنة 2018 بشأن إنشاء دائرة الطاقة.
- القانون رقم (2) لسنة 1998 بشأن تنظيم قطاع الماء والكهرباء في إمارة أبوظبي وتعديلاته.
- قرار رئيس المجلس التنفيذي رقم (26) لسنة 2018 بشأن اختصاصات إضافية لدائرة الطاقة.
- قرار اللجنة التنفيذية رقم 04/007/2/2019 بشأن استراتيجية أبوظبي لإدارة جانب الطلب وترشيد استخدام الطاقة 2030.
- قرار رئيس دائرة الطاقة رقم (22) لسنة 2020 بشأن جدول المخالفات والغرامات الإدارية.
- قرار رئيس دائرة الطاقة رقم (10) لسنة 2021 بشأن تسجيل وتداول شهادات الطاقة النظيفة في إمارة أبوظبي.
تقرر ما يلي:
مادة (1)
تدخل أحكام "السياسة التنظيمية لشهادات إنتاج المياه منخفضة الكربون" المرفقة بهذا القرار حيز التنفيذ.
مادة (2)
تطبق الأحكام التنظيمية الواردة في السياسة المرفقة على كافة المعاملات الخاصة بإصدار وتسجيل وتداول واستخدام شهادات إنتاج المياه منخفضة الكربون في إمارة أبوظبي.
مادة (3)
تلتزم كافة الأفراد والجهات والشركات الحكومية والخاصة الراغبة في تسجيل أو تداول أو استخدام شهادات إنتاج المياه منخفضة الكربون في إمارة أبوظبي بكافة أحكام السياسة المرفقة والإجراءات والقرارات والموافقات التنظيمية الصادرة وفقا لها.
مادة (4)
تلتزم الجهات المرخصة من جانب الدائرة والراغبة في تسجيل أو تداول شهادات إنتاج المياه منخفضة الكربون بالحصول على موافقة تنظيمية مسبقة من الدائرة وفقا لشروط التراخيص الصادرة لهم.
مادة (5)
يحظر تداول أو استخدام شهادات إنتاج المياه منخفضة الكربون خارج إمارة أبوظبي بدون الحصول على موافقة مسبقة من الدائرة.
مادة (6)
يتولى وكيل الدائرة مسؤولية إصدار الإجراءات والقرارات والموافقات التنظيمية اللازمة لتنفيذ المواد الواردة بهذا القرار والسياسة المرفقة.
مادة (7)
يعمل بهذا القرار اعتبارا من تاريخ صدوره ويتم نشره في الجريدة الرسمية.

Regarding the Regulatory Policy for Low-Carbon Water Production Certificates
The Chairman of the Department of Energy,
Having reviewed:
- Law No. (1) of 1974 concerning the Reorganization of the Governmental Body in the Emirate of Abu Dhabi and its amendments.
- Law No. (11) of 2018 establishing the Department of Energy.
- Law No. (2) of 1998 concerning the Regulation of the Water and Electricity Sector in the Emirate of Abu Dhabi and its amendments.
- Executive Council Chairman's Resolution No. (26) of 2018 concerning Additional Competencies for the Department of Energy.
- Executive Committee Resolution No. 04/007/2/2019 concerning the Abu Dhabi Demand Side Management and Energy Rationalization Strategy 2030.
- Chairman of the Department of Energy Resolution No. (22) of 2020 concerning the Schedule of Violations and Administrative Fines.
- Chairman of the Department of Energy Resolution No. (10) of 2021 concerning the Registration and Trading of Clean Energy Certificates in the Emirate of Abu Dhabi.
Has decided as follows:
Article (1)
The provisions of the "Regulatory Policy for Low-Carbon Water Production Certificates" attached to this Resolution shall come into force.
Article (2)
The regulatory provisions contained in the attached Policy shall apply to all transactions related to the issuance, registration, trading, and use of Low-Carbon Water Production Certificates in the Emirate of Abu Dhabi.
Article (3)
All individuals, entities, and governmental and private companies wishing to register, trade, or use Low-Carbon Water Production Certificates in the Emirate of Abu Dhabi shall comply with all provisions of the attached Policy and the regulatory procedures, resolutions, and approvals issued accordingly.
Article (4)
Entities licensed by the Department and wishing to register or trade Low-Carbon Water Production Certificates shall obtain prior regulatory approval from the Department in accordance with the terms of their issued licenses.
Article (5)
It is prohibited to trade or use Low-Carbon Water Production Certificates outside the Emirate of Abu Dhabi without obtaining prior approval from the Department.
Article (6)
The Undersecretary of the Department shall be responsible for issuing the necessary regulatory procedures, resolutions, and approvals to implement the articles contained in this Resolution and the attached Policy.
Article (7)
This Resolution shall be effective from the date of its issuance and shall be published in the Official Gazette.
