بتعديل قرار رئيس دائرة الطاقة رقم (7) لسنة 2018 بشأن الإجراءات والشروط الميسرة لتراخيص الأنشطة المنظمة المحدودة النطاق
رئيس دائرة الطاقة
- - بعد الإطلاع على القانون رقم (1) لسنة 1974 بإعادة تنظيم الجهاز الحكومي بإمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (2) لسنة 1998 بشأن تنظيم قطاع الماء والكهرباء في إمارة أبوظبي وتعديلاته.
- - وعلى القانون رقم (1) لسنة 2017 بشأن النظام المالي لحكومة أبوظبي.
- - وعلى القانون رقم (11) لسنة 2018 في شأن إنشاء دائرة الطاقة.
- - وعلى قرار اللجنة التنفيذية رقم (2018/2/035/10) بشأن إلغاء قرار اللجنة التنفيذية رقم (26 ج 2018/26) بشأن سياسة استخدام الألواح الشمسية الكهروضوئية والطاقة المتجددة للأنظمة المربوطة بالشبكة.
- - وعلى قرار رئيس دائرة الطاقة رقم (7) لسنة 2018 بشأن الإجراءات والشروط الميسرة لتراخيص الأنشطة المنظمة المحدودة النطاق.
تقرر ما يلي:-
المادة الأولى
تستبدل بالمادة (1) من قرار رئيس دائرة الطاقة رقم (7) لسنة 2018 المشار إليه المادة التالية:
مادة (1)
الأنشطة المحدودة النطاق
- 1. يحظر على أي فرد أو جهة أو منشأة مزاولة أي من الأنشطة المحدودة النطاق دون الحصول على ترخيص بذلك من دائرة الطاقة وفقًا لأحكام هذا القرار.
- 2. تطبق أحكام هذا القرار على الأفراد والجهات والمنشآت التي تباشر الأنشطة المحدودة النطاق التالية:

كافة أنواع وتقنيات توليد الكهرباء لأغراض التزويد الذاتي باستثناء توليد الكهرباء بواسطة الطاقة الشمسية. |
الطاقة الانتاجية التي لا تزيد عن 5 ميجاواط في المنشأة الواحدة وبما لا يتعدى 25 ميجاواط لمجموع الطاقة الانتاجية الصافية المعلنة للكهرباء. |

- كل من كانت أنشطته مقصورة على أغراض التزويد الذاتي.
- لا يتطلب نشاط تخزين المياه أو الكهرباء أي ترخيص حين يكون مكملاً لنشاط مرخص آخر. |

المادة الثانية
لدائرة الطاقة التشاور مع أي من الشركات العاملة في قطاع الطاقة في إمارة أبوظبي قبل إصدار أي ترخيص للأنشطة المحدودة النطاق أو إلغاء تلك التراخيص في حال وجود تعارض مع السياسات والأنظمة المعتمدة في القطاع.
المادة الثالثة
تلغى كافة تراخيص توليد الكهرباء بواسطة الطاقة الشمسية للأنظمة المربوطة بشبكة التوزيع في المنشآت السكنية باستثناء المشاريع التجريبية والأنظمة الكهربائية غير المربوطة بشبكة التوزيع، على أن تقوم الدائرة باتخاذ الإجراءات الضرورية لإلغاء تلك التراخيص واخطار الجهات والأشخاص المتأثرة بذلك وفق النظم المتبعة وشروط تلك التراخيص.
المادة الرابعة
يعلق مؤقتاً إصدار أي تراخيص لتوليد الكهرباء بواسطة الطاقة الشمسية للأنظمة المربوطة بشبكة التوزيع في المنشآت السكنية باستثناء المشاريع التجريبية والأنظمة الكهربائية غير المربوطة بشبكة التوزيع، إلى حين صدور قرار بإعادة العمل بتلك التراخيص من رئيس دائرة الطاقة.
المادة الخامسة
يلغى كل حكم أو قرار يخالف او يتعارض مع أحكام هذا القرار.
المادة السادسة
يعمل بهذا القرار اعتباراً من تاريخ صدوره، ويعمم حيث تدعو الحاجة.

Amending the Decision of the Chairman of the Department of Energy No. (7) for the Year 2018 Regarding the Facilitated Procedures and Conditions for Licensing Limited-Scope Regulated Activities
The Chairman of the Department of Energy
- - Having reviewed Law No. (1) of 1974 on the Reorganization of the Governmental Body in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (2) of 1998 on the Regulation of the Water and Electricity Sector in the Emirate of Abu Dhabi and its amendments.
- - And Law No. (1) of 2017 on the Financial System of the Government of Abu Dhabi.
- - And Law No. (11) of 2018 on the Establishment of the Department of Energy.
- - And Executive Committee Decision No. (10/035/2/2018) regarding the cancellation of Executive Committee Decision No. (26/2018/26 G) on the Policy for the Use of Photovoltaic Solar Panels and Renewable Energy for Grid-Connected Systems.
- - And the Decision of the Chairman of the Department of Energy No. (7) for the Year 2018 Regarding the Facilitated Procedures and Conditions for Licensing Limited-Scope Regulated Activities.
Has decided as follows:-
Article One
Article (1) of the aforementioned Decision of the Chairman of the Department of Energy No. (7) for the Year 2018 shall be replaced by the following article:
Article (1)
Limited-Scope Activities
- 1. No individual, entity, or establishment shall practice any of the limited-scope activities without obtaining a license from the Department of Energy in accordance with the provisions of this Decision.
- 2. The provisions of this Decision shall apply to individuals, entities, and establishments that carry out the following limited-scope activities:

Article Two
The Department of Energy may consult with any of the companies operating in the energy sector in the Emirate of Abu Dhabi before issuing any license for limited-scope activities or canceling such licenses in the event of a conflict with the approved policies and regulations in the sector.
Article Three
All licenses for electricity generation by solar power for systems connected to the distribution network in residential establishments are hereby canceled, with the exception of pilot projects and electrical systems not connected to the distribution network. The Department shall take the necessary measures to cancel these licenses and notify the affected entities and persons in accordance with the established regulations and the terms of those licenses.
Article Four
The issuance of any licenses for electricity generation by solar power for systems connected to the distribution network in residential establishments is temporarily suspended, with the exception of pilot projects and electrical systems not connected to the distribution network, until a decision is issued by the Chairman of the Department of Energy to resume these licenses.
Article Five
Any provision or decision that contradicts or conflicts with the provisions of this Decision is hereby repealed.
Article Six
This Decision shall come into effect from the date of its issuance and shall be circulated as needed.
